General
- Deep Blue Co., Ltd (hereafter Deep Blue), TAT number 34/03030, offers boat tours in Thailand and arranges boat tours.
- By renting a boat or purchasing a tour you accept our General Terms and Conditions defined below.
Private Charter
- The minimum rental time for a cruise is two hours. The boat rental including all costs for meals and additional add-ons must be paid in full before the start of the cruise. Payments are accepted in cash, by bank transfer, credit card (via PayPal) or Bitcoin. In the case of short-term bookings, it is exceptionally possible to pay directly before boarding the boat if the receipt of payment can be determined before departure (direct transfer or cash).
- Boat rentals from Deep Blue always includes licensed Captain and crew.
- It is not allowed to sublet the boat to a third party
- The boat rental includes all the services mentioned in our agreements and writen chats. Often more, but never less. If certain services offered are not used voluntarily or if services are expected that go beyond the agreed service, no claim for reimbursement can be derived from this. This also applies to self-inflicted delays or tour cancellations due to rule-breaking behavior.
- Taxis that we have ordered for the transfer usually wait a maximum of 15 minutes. The ship crews wait a maximum of 1 hour. If the customer do not start the trip on time and do not arrange this with us separately, the lost tour time is non-refundable.
- If the customer are late to start the tour, the yacht captain may decide to change the planned itinerary depending on the delay. An extension of the tour beyond the previously fixed time is not possible. Waiting time is always cruising time.
Execution
- Deep Blue reserves the right to change routes and start and end locations if weather conditions or other legitimate reasons so require.
- The captain is always responsible and has the final decision-making power. Safety comes first.
- In the event of misconduct that endangers safety or property damage, the captain has the right to interrupt the voyage or end it immediately. According to Thai law, persons under the influence of alcohol/drugs must be denied access to the boat. In such a case, the customer's payment obligation remains.
- Passengers must follow all crew instructions immediately and without delay. This also applies to putting on life jackets. Beside of controlled areas by the Marine departement, wearing supplied live jackets is strongly recommended at all time.
- Access to ships and jetties can be refused without reason if this is deemed necessary by the crew, e.g. with regard to capacity, safety, public order or the imminent risk of damage or nuisance.
- The passenger is expected to take care of the environment and not to dispose waste in the water. All personal consumptions and the associated waste should be disposed in the appropriate bins available on the boat.
- Obvious errors and mistakes in the information provided, and/or published by Deep Blue will not bind Deep Blue The Thai consumer law applies to these general terms and conditions. Disputes must be submitted to the competent court in the place where the consumer or passenger resides.
Liability
- Deep Blue is not liable for damage and/or loss of passenger property. Passengers take all their belongings on board at their own risk.
- Deep Blue shall not be liable for any personal injury or property damage of any kind, regardless of its cause, before, during or as a result of the trip. This does not apply to damage caused by an intentional act or gross negligence on the part of Deep Blue were caused. The statutory compensation is limited to the price of the boat rental for the trip in question.
- Deep Blue shall not be liable for any damage to persons or property of passengers caused by stepping on or boarding a jetty or boat. Passengers enter these areas entirely at their own risk.
- Guests are liable for any damage they cause to the items/goods used by Deep Blue or third parties.
- All activities organized by Deep Blue take place at your own risk.
- Children are the responsibility of parents. Children under the age of 4 are required to sit on their parents' laps.
- Should Deep Blue not be able to comply with their obligations due to force majeure, there is no entitlement to restitution or compensation.
Payment and cancellation
- Deep Blue reserves the right to cancel or reschedule the trip due to unforeseen weather conditions or mechanical problems. In such a case, an alternative date or a full refund will be offered.
- When booking a private Charter, 50% are due at the booking time, and the remaining 50% are due at latest 7 days before the trip start.
- In case where the customer cancels his booking more than 7 days before the trip date, the 50% booking deposit will not be refunded.
- Failing to pay in full the remaining 50% at the latest 7 days before the scheduled start time will be deemed to be a cancellation of the trip by the customer. The 50% booking deposit will not be refunded.
- In case where the customer cancels his booking within 7 days before the trip date, the trip payment will not be refunded.
